Terms and Conditions for the VANFITTERY Brand Ambassador Programme

To ensure that the whole process is fair, transparent and straightforward for both parties, the following rules apply to our brand ambassador programme:

§ 1 Purpose of the programme

As a brand ambassador, you’ll enable prospective customers in your region to see your installed VANFITTERY modules in person. Participation is only from the age of 18 Permitted. Notifications made under this programme (in particular registrations, cancellations and objections to changes in the terms and conditions) must be submitted in writing (an email is sufficient).

The contractual relationship comes into effect as soon as CzoppikEngineering GmbH (trading under the VANFITTERY brand, hereinafter „VANFITTERY“) has offered you participation by email and you have expressly accepted the terms and conditions of participation linked in that email. From this point onwards, all rights and obligations described herein shall apply.

This programme is aimed exclusively at private individuals. Participation does not, expressly, create any employment, agency or commercial representation relationship between you and VANFITTERY. You are acting as a private referrer and are neither authorised nor obliged to conduct sales discussions on our behalf, make any legal commitments or grant discounts (apart from those available via your personal code).

§ 2 Procedure for meetings

You are completely free to organise your own time. There are no fixed deadlines or quotas.

If a prospective customer is interested in your setup via our brand ambassador card, they will fill in an enquiry form. We receive this enquiry and forward it to you by email for further discussion. It’s entirely up to you to decide whether, when and where you arrange a meeting. If you don’t wish to accept an enquiry for reasons of time or personal circumstances, that’s perfectly fine.

§ 3 Your bonus, tax & payout

For every order successfully referred, you will receive a bonus of 50.00 euros from us. Only orders containing at least one of the following modules are eligible for the bonus:

• Van bed system
• Cross pull-out bed system
• CampingBox Pro
• CampingBox Classic
• CampingBox Vario
• Van kitchen
• „The Minimalist“ kitchen unit“
• Storage space plus
• Cool box module
• EuroBox module

Orders containing only other accessories and none of the modules listed above are not eligible for the bonus. Regardless of the number of modules ordered, the bonus is paid once per order placed.

• Assignment: The referral will be credited to you as soon as the prospective customer redeems your personal discount code when placing an online order in our shop. As a general rule, the discount code redeemed at checkout applies without exception. Should a prospective customer forget to enter the code, VANFITTERY may, as a purely voluntary gesture of goodwill, assign the referral retrospectively; however, there is expressly no legal entitlement to such retrospective assignment or payment. Commission is awarded solely on the basis of the discount code redeemed at checkout. Commission cannot be split between multiple brand ambassadors. The discount code used by the customer in the shop is the sole determining factor for commission eligibility.
• Withdrawal conditions: Entitlement to the bonus only arises once the order has been paid for in full, the goods have been delivered and the buyer’s statutory 14-day cancellation period has expired. There is no entitlement to the bonus for cancelled, revoked or subsequently reversed orders (e.g. due to material defects, warranty claims or goodwill gestures).
• Recovery of premiums already paid: You must immediately repay any bonuses already paid out for orders that are subsequently cancelled, revoked or reversed. VANFITTERY is entitled to set off such amounts to be reclaimed against future bonus entitlements. If such an offset is not possible (e.g. because no further bonuses are due or you have terminated your participation in the programme), you are obliged to repay the corresponding amount directly.
• Payout: The rewards you have earned are calculated monthly and transferred to a bank account of your choice at the end of the following month. As soon as we receive the first order placed using your personal code, we will contact you by email.

§ 4 Use and Sharing of the Discount Code, Brand Image

Your personal discount code is intended exclusively for prospective customers whom you advise personally as part of this programme or to whom you demonstrate your setup. Publishing the code on voucher portals (e.g. MyDealz), in discount forums or systematically distributing it via automated channels is strictly prohibited. Any other form of sharing or publication – particularly on social media channels (e.g. Instagram, TikTok, YouTube, Facebook), on blogs, forums, group chats or via mass mailings – is expressly prohibited, regardless of whether the post is public or accessible only to a restricted group of people. Any breach of this obligation is prohibited and will result in immediate exclusion from the programme as well as Forfeiture of all commissions generated by this unauthorised distribution.

Furthermore, you are not permitted to act officially on behalf of VANFITTERY. In particular, this means: You must not use our company logo on your own channels, create social media accounts that give the impression of being official VANFITTERY profiles, or place paid search engine adverts (e.g. Google Ads) using our brand terms.

§ 5 Disclaimer

Meetings between you and interested parties are private arrangements. VANFITTERY merely facilitates the initial contact. We accept no liability for any damage, accidents or property damage (e.g. to the vehicle or the modules) arising during such a meeting. You are personally responsible for ensuring that you and your vehicle are adequately insured (in particular, that you have valid motor third-party liability insurance).

Furthermore, VANFITTERY accepts no liability for any statements, information or promises you make to prospective customers. In particular, we accept no responsibility for incorrect or misleading statements regarding the compatibility, functionality or other characteristics of our products. We accept no liability for any financial losses incurred by prospective customers as a result of incorrect information provided by you.

However, these exclusions of liability do not apply to damages resulting from loss of life, personal injury or damage to health, nor to damages arising from a breach of duty by VANFITTERY, our legal representatives or our vicarious agents committed with intent or through gross negligence.

§ 6 Data Protection

By taking part, you agree that we may publish your first name, the general region where you are based (town/district, without a specific address), your vehicle model and the modules fitted on our website (Brand Ambassador Map). Your email address and surname will remain hidden from website visitors. The principles and details of data processing within the framework of this programme are set out in our Privacy Policy.

We will only forward enquiries from prospective customers to you if the prospective customer has expressly consented in the enquiry form to their contact details (e.g. name, email address) being passed on to you for this purpose. You process this data solely on the basis of the prospective customer’s consent and are yourself responsible for this sub-process under data protection law within the meaning of the GDPR.

You undertake to use the data received to be treated as strictly confidential, to be used exclusively for the purpose of arranging appointments and not to be disclosed to third parties. You are obliged to delete this data immediately and in full as soon as the meeting has taken place or it becomes clear that no meeting will take place. Furthermore, you are obliged to protect the data received from access by third parties whilst it is in your possession (e.g. by using encrypted communication channels and storing notes securely).

§ 7 Rights of use in respect of visual material

If, as part of your participation, you provide us with photographs or other visual material (e.g. of your vehicle or your VANFITTERY setup), you thereby grant VANFITTERY a non-exclusive right to use these images within the framework of the Brand Ambassador Programme, without any restrictions as to time or place (in particular for publication on the Brand Ambassador map and on our other communication channels).

You warrant that you hold all rights to the image material submitted, or are authorised to grant these rights of use, and that the use of the images does not infringe any third-party rights (e.g. the personal rights of persons depicted, rights relating to recognisable third-party vehicle registration numbers or copyright) will not be infringed. You shall be liable for any damages incurred by VANFITTERY as a result of a breach of this warranty.

§ 8 Termination and Amendment of the Terms and Conditions

You can opt out of the programme at any time without notice – a quick email to us is all it takes. We also reserve the right to terminate the programme or individual participations at any time. Upon termination, your profile will be removed from the map immediately and your discount code deactivated. Naturally, we will still pay out any rewards that have been legitimately generated and are valid up to that point.

We reserve the right to amend these terms and conditions of participation in future. The following distinction applies:

• Minor changes (e.g. editorial corrections, clarifications, new examples of exclusions for the discount code): We will notify you by email at least four weeks before the changes come into effect. If you do not object within this period, the changes will be deemed to have been accepted. We will expressly draw your attention to this consequence in the notification.
• Significant changes (in particular, changes to the reward amount or the reward scheme): These will only take effect with your active consent, which we will seek separately. If you do not give your consent, your participation in the programme will end, and any reward entitlements you have already accrued will remain unaffected.

§ 9 Final Provisions

The contracting party for this programme is VANFITTERY, Hauptstraße 40, 84103 Postau, Germany. The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

To the extent permitted by law, the place of jurisdiction for all disputes arising from this programme shall be Landshut. For participants resident in another EU Member State, the mandatory consumer protection provisions of their respective country of residence shall apply in addition, insofar as these are more favourable to the participant.

Note on online dispute resolution: The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/ can be contacted. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

Should any provision of these Terms and Conditions of Participation be or become invalid, in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the legally permissible provision that most closely approximates the economic purpose of the invalid provision.
